Over 6 months ago I did a transaction with one of the Board Moderators here, 5SIZ (aka Sergio Gutierrez). He had a set of SLP runners for sale for cheap, but he wanted a set of stock runners to replace them (he planned to sell the car). I wanted to do the deal, and I had a set of stock runners to trade (like a core), but they had imperfections. I made this very clear to Sergio (copied exactly from email):

"The pass side runner has two dents, one on the outside runner and one on the inside runner. It seemed like a junkyard pull, they cut everything and the motor must have fallen. Only one runner has dents, the drivers side runner is fine. If you are OK with this then I can send overnight mail on Monday. It should get there on Tues. The gaskets got damaged when I removed them so I bought a new gasket set (last one on the island lol), and the parts will come with new gaskets. I did not remove the old gaskets as the surface needs to be perfect, so I did not want to chance making them imperfect."

and Sergio replied with:

"that's fine with me, go ahead and send the runners over, I'll be waiting for it on Tuesday , I really want to get you these runners!
The guy is going to buy the car off of me on Friday, but I'm keeping the car and he's getting the title because he is only putting half down, so I will have it for a while longer, and he knows the runners have your name on them."

Needless to say I did not get any runners in the mail. Instead Sergio had decided he did not want the stock runners after he saw them, and mailed me the package back. Fine, so I got the **** end of the stick (stuck paying shipping which is $40 BTW). But the problem is he accepted the the Paypal payment and I did not receive any SLP runners or a refund in exchange. He said he would refund me the money, but when I tried to get the refund it did not work. My PM's and Emails to Sergio have been ignored. The last update I have from him over 6 months ago is "I dont know what happened." Now not only am I out for the shipping and a set of gaskets, and the time of removing all this stuff from a running L98 (and the car being down), I'm also out $180 on the deal for the SLP runners. I estime the entire deal has cost me $300 (shipping, gaskets, and the money he kept) and all I got in return was a bad vibe about buying stuff from Moderators on Thirdgen.Org. So if any of you are going to deal with 5SIZ (aka Sergio Gutierrez) watch out because he might just take your money and run.

5SIZ (aka Sergio Gutierrez) if you are reading this and you would finnaly like to rectify the situation, please reply to one of the ten thousand PM's or Emails I have sent you and I will be happy to delete this thread. I want my damn money back.

hmmm kinda funny how i didnt direct the comment twords anyone particular. also, i have been called much worse by the mods on this board. i was simply asking, how do they select the people to be mods? and why are some of these mods setting a bad example for the rest?

no offense but it seems to me that statment is saying mods are better then the rest of us? ive been in a long nasty fight with another mod on this board before and we ended up PMing eachother. eventually everything was settled. im not trying to T you off man, but what you wrote can be taken in different ways...

You said "Where do they find these ******", which I took as a direct comment about the moderators. If you have been called names by a mod, I suggest that you report it to the admin. They will settle it.

I did not say that mods are better than anyone. We have a thankless job, and we dont need anyone talking trash about us. We do this job because we enjoy TGO and most of the people. If you were offended, I apologize. I was only trying to state that I will not allow bashing of ANYONE on the boards that I moderate.

With that said, this thread will be closed if this topic keeps going. I will allow it to remain open just so others may post about the original topic. I will delete any other topics in this thread.

Well I am a personal friend of 5siz, and just for some FYI I can tell you he's not responding to any PM's or email's because he sold his computer and can no longer get on the internet (temporarily). If you guys want I can relay messages to him.

 

Moderator or not,that dosent give him the right to shaft anyone.Thanks for putting his name out there though.Seems like he's screwed people before on this site.

 

IMHO opinion this is completly wrong. first off i think if 5siz is still a mod then we cant let him to continue being so. mods are supposed to be example setters and this is ont setting examples. however we have to make sure this is 100 accurate. not trying to test the accountability of both of these members but with no proof nothin should be assumed. also, if 5siz had unresolved issues (nad major ones like this) he should have made sure to settle it before or have another computer handy to settle it with.

not biased towards mods or members alike buit just stating the obvious.

please get this resolved, ive been burned twice before and its not fun at all

He knows what happened with the money wich he doesn't seem to believe. I sent him the money I owed him back to his girlfirends paypal, wich he DECLINED PAYMENT and sent it back to me for reasons wich I do not remember. Then when I tried to transfer the money to my bank account to mke a M/O it disappeared, yes you heard me IT DISAPPEARED, I have the proof it was sent to my bank and it was never recieved by the bank, i called paypal and they said it was the banks problem, then I called the bank and they said it was paypals problem, this has gone on for months between paypal and my bank, I do not have 200 bucks to just whip out and send, I need to save.


For everyone that knows me, they will put money down on my credibility. I am a mod because Dirk made me one, and because he TRUST ME, he knows I wouldn't screw someone over period.

First of all Sergio, I have sent you PM's about this while seeing your name in the 'users currently browsing this forum' section of various forums on these messageboards. This indicates that weather or not you have sold your computer, you were browsing the forums while I was sending you PM's. And we both know the forums work the same for both of us, whenever you log on, it will give you a pop-up saying you have a new PM. Obviously you are ignoring me. I have also sent you numerous emails about this and never got a reply. We both know your email is web based, meaning you can check it from any computer in the world, and considering that you are browsing the forums, I know you have access to view your email. And comon, posting under someone elses username? Be a man and log into your own account and reply to me. We both know you can log into these forums from any computer in the world. No excuses here Sergio.

Second off, I did not decline payment. I tried to accept payment but my paypal did not accept the payment because I did not verify a checking account with paypal. This is not something I blame on you as you had no control over this. This is something I blame on paypal because it was not clear that it was impossible to receive payments without first verifying your bank (aka it would be automatically rejected). This is not why I'm having a problem with you.

So what you are basically telling me is that something 'went wrong' between your bank and paypal, and now I'm out $180 forever? So now I have to loose out because your bank has an issue with paypal? And on top of that, you completely ignore every PM or email I have sent asking for an update on whats going on? Its not like I've been impatient here Sergio. I've waited 6 months to get my money back, and still I have nothing, and still I'm getting ignored.

I think this has alot to say about your character Sergio. If I were in your shoes, I would have sent back the $180 regardless of what happened between my bank and paypal. I would not have screwed over the other person, because obviously it has nothing to do with them. And on top of that, I wouldnt be ignoring them for 6 months which would probably lead them to believe they are getting ripped off. The fact of the matter is that $180 was for parts that I never got. I dont care what excuses you have. I dont care about your bank or paypal. I want my damn money back. I hate to be 'rude' about it. But you've blown me off for 6 months and now I'm really pissed off. You're damn right that you have to save up. You have to save up $180 and send me my damn money back.

 

EDIT: Nevermind, I was going to input my thoughts, but I reread the original post and I don't know what to say. You guys are on your own.

Just a comment from a "newbie" I got screwed out of some $ on here as well (Digimagix/Erik Kehl) why does it always seem like one excuse after another with these guys?Like I said before thanks for letting us know Crazy.I hope it works out for you.

All I can say in all honesty is this:


Crazy Hawaiian is an AWESOME person to deal with, he keep in touch and he does everything by the book. A+ buyer and seller.

I am one in the same, all of the other feedbacks I have recieved have all been settled and were minor set backs, the one with the headers just so happened to occur right at the same time as crazy hawaiians fiasco, i will go o further than that.


I'm seriouse get me banned. maybe that will make all the morons in this thread aside from my friends and CH happy. u newbies have know idea who I am and what I debt I have been to these boards, go look up the tech articles..member for 5 years and just up to this last one is where everything went down hill.

I dont know if you're asking for my opinion, but I dont think you should lose Moderator status or be banned. These feedback forums are here to resolve issues when buying and selling stuff, and I think that should be the extent of what happens. I know stuff goes wrong sometimes, and thats fine, it happens to me too. But when you stop replying to peoples questions asking whats the status of money owed, thats when things go wrong. I can sense a hint of sarcasm in what you are saying, and I know I'm not the best organized person in the world, but I felt I've been wronged so I had to speak up. In all honesty, all you have to tell me is that you are still trying to find out what happened between Paypal and the Bank and I'll be a happy guy. Right now I feel like you dont care at all, you have no intent to follow up with the bank, and I'm out $180 forever.

I know Sergio, and would have to say that this does not sound like him. Just my 2 cents.

I will not take sides on this matter, as I am a mod on this board. I will, however, make sure that this is handled in a civil way. Please do not turn this into a flame war.

 

I also had a little problem with "5SIZ" He was going to buy some hood blisters from me. He wanted them quick and I was going to send them out but I waited till he paypaled the money since I have been left in the dust before. Im glad I didnt send them cuz I never got the money. I pm'd him and tracked them. He read them but never got back. He also deleted all the pm's in my inbox about the blisters.

 

um i dont think tampering with mail is a good idea. i know its a felony to tamper with the mail in peoples mail boxes, not sure about online though

Well, somehow I thought I still might get my money back, but guess not. Found out yesterday that Sergio decided to purchase a nitrous kit instead of paying me back. Sergio you deadbeat. Give me my damn money back or at least dont rub it in my face you punk! Or maybe be a man and send me the runners I paid for! Sheat!

 

Wow... just... wow. It's one thing to have read everything that happened, but to find out he bought a nitrous kit 4 months later, plans on blowing up his motor with it and getting a 350, and still has not paid CrazyHawaiian is ludicrous. I admit, I don't know 5SIZ very well, but I do know CrazyHawaiian from the boards fairly well, and I know I'd trust him. You've got my support.

 

Thanks for the support guys. Sergio has PM'd me and he says he will be mailing me the SLP runners that I had originally paid for. So thanks for getting back to me Sergio. It unfortunate that it took a lot of bitching on my part over the course of almost one whole year, but I appreciate that you have decided to do the right thing.

Just wanted to let everyone know that I have talked with Sergio again, and he did not change his screen name to avoid me, he changed it because of his new ride (that he traded his car for). He will be keeping in contact with me and he does intend to repay me as soon as he can. I would like to say think you to everyone else on these boards that has been supporting me on this issue.

Wow, this is a crazy scenario! I've been on the boards for a long time and this is definitely one of the goofiest misfortunate "deals gone bad" episode I've seen in quite a while. But let's not let this thread die! Good luck Crazy H!

 

Kinda sad if you ask me..... I'm not involved in all of this, but it sure seems that if something went wrong with a transaction I was involved in, I would REALLY try to make it right with my buyer. Even if I had to send it to him in payments of $10 at a time. By now it could nearly be paid off if he would have given you $10 from each pay check !! Then you are happy that the transaction is taken care of, and he isn't out $180 all at once. I know it must suck for him to owe you that kind of money, but he could "man up" and Pay Up instead of playing name games on the boards.
I sell a lot of stuff here on the boards to guys (and girls) who need parts to get thier ride going, and I hate it when somone who just doesn't care comes along and sells someone something and doesn't follow thru, making everyone leery about buying stuff when it all comes down to a few people who just don't care.

C-Hawaiian....good luck on this man.... obviously this is a topic I hate to see, especially in a place where everyone is united in a cause (3rd gens) and is like a big family. Too bad there always has to be that brother who just doesn't care about the rest of the family.........

5SIZ is no longer a mod on this site. The mods have a thankless job, and do it for free. There is only so much that we can do.

I do wish that we could enforce situations like this, but we are not empowered to do such things. Please do not think that all mods are so narrow-minded, as our hands are tied.
