That's what I would do actually the first thing I would do is find a different attorney I think what he actually meant was it wasn't worth his time. If your story is completely true why should you have to pay? But this is what I was most afraid of though is you looked at it thinking it needed a new hood bumper and mirror but more things were bent underneath. Good luck to you but I know if it was me I would make them pay somehow even if you only get $500, just for the principal of the matter if they are gonna act like that. Besides how could they buy into anything? They weren't there and they can either believe their 15 year old son or some guy that wants to sue them, who would you believe?

I dealt with a similar situation with a phone I bought on ebay and even though it was only $100 I didn't care it was about the principal of the matter and making people responsible for their actions. After dealing with this guy for about a month I told him I was gonna contact an attorney and to keep in mind what court costs, attorney fees, a plane ticket for me to get there and back and what missed wages from work would cost. The next day I got 2 emails from him one stating he finds my emails very threatening and another saying how he decided to refund me but he contacted an attorney and informed local authorities about me because I was threatening him but I got my money back from him and hopefully he will think twice about ripping someone off on ebay next time. It's up to you what to do but if they are trying to say this isn't their problem why should you be decent with them?

I believe small claims court would work great. I think in TX it's a $10K max. He's a kid too. Not sure on that. Sorry to hear that. A deer ran into me and I didn't tell anyone but the body shop. $2200 in damage.

You were too nice to the kid. If it were me, I don't distinguish between kid, man or woman. I just go at it in certain cases and in THIS case, I'd probably have given the punk a few licks upside his stomach.

Oh and you can sue a kid via small claims court. Either the parents would pay or the judgment would hang over the kid until he/she reached 18 and then you can start collecting the money. There is a ton of court shows like Judge Mathis, Judy, Joe Brown (I prefer Joe Brown or even Mathis) to name a few.

I understand what everyone is saying but in TX anyways the OP may be right in dropping it. Yes the courts would have probably found the kid / parents liable but then they might refuse to pay the judgement and your recourses may not make them change their mind about paying. In the end they may never pay with more and more outlay from your own pocket.
Shows like Judge Judy etc pay the people to have their cases aired on TV and settlements come out of that but if it doesn't cover the whole amount then though a legal ruling you still may not get paid. Depends on your state laws.
And though I would like to agree with others that they would have roughed the kid up some the problem there is the possibility of assault charges then.
I don't like that it happened but it sure seems that you may be making the right decision to drop it. I just hope that you get all the alignment issues figured out on the cheap. Good luck!!!

you "tough guys" realize if you touch the kid YOU will be sued and probably go to jail right? thats assault where i come from.

you need to keep your cool when things like this happen, trying to be a "tough guy" can get you into serious trouble, or worse.

sucks it happened, glad everybody is ok, and you should be able to get the damage paid for through the kids parents, since it seems pretty obvious the teenager was at fault and being careless

OP about the same time you had your 'accident' some older gentlemen t-boned me in my mustang. There wasn't much damage but I made a big deal about it, long story short I took it to the dealership for the most expensive repair and a free rental car. Dropping it may be the mature thing to do but the kids parents should have offered to pay for your car.

Sucks about your car but thats what insurance is for, if anything maaaybe the ins deductible would be out of pocket so some help there possibly.

First thing judge would ask you anyway is did you have ins and did they pay...proof of it also.



We all like our cars but thats a human life youre dealing with not sheetmetal and bolts.



BTW minors have LOTS of rights, lay one hand on them and youll be paying them for many many yrs and most of them know it.

For everyone who said i should have gave him a few licks. Belive me i wanted to but with eye witnesses everywhere can't do it. I still need a black gta fender because i did not notice at time of the accident i have fender damage but it has a big crack in the center of the fender.

of course noone's going to abuse a child... i was wrecked into by a tipsy woman's benz one night on my way from work, but i didn't (and wouldn't have) hit her lol

incedentally, BOTH our insurance companies found me not at fault, so then she SUED me for $8k. The jury found me not at fault again... I ended up fixing my own car (didn't get her insurance info..) without any fighting or beating up..

even had this kid been a grown man, i wouldn't have touched him in anger until he said something about not paying
